UPPER HANOVER TOWNSHIP BOARD OF SUPERVISORS REGULAR MEETING MINUTES OF DECEMBER 12, 2017

 

 

Call to Order and Roll Call

 

The meeting was called to order at 7:04 p.m. by Chairman Eugene Fried followed by the Pledge of Allegiance to the Flag. Township Supervisors in attendance were Dorothy Diehl, Richard Fain, Ben Fiorito, Eugene Fried, and Steven Rothenberger.  Staff members in attendance were Joseph Bresnan, Township Solicitor, Thomas Latshaw, Road Foreman, Michael Wetzel, Fire Marshal, John Weber, Township Engineer and Stanley W. Seitzinger, Jr., Township Manager.

 

Citizen Comments

 

Citizens in attendance did not present comments.

 

Approval of Minutes

 

Mr. Rothenberger moved to approve the November 13, 2017 Workshop Meeting Minutes and the November 14, 2017 Regular Meeting Minutes.  The motion was seconded by Mr. Fiorito and carried unanimously.

 

A.  Previously Paid Bills Authorization

 

There were not any previously paid bills listed for approval.

 

B.  Approval of Monthly Bills to be Paid

 

Mrs. Diehl moved to approve the monthly bills payment in the General Fund in the amount of $769,087.44, Parks and Recreation Fund in the amount of $987.95 and Escrow Fund in the amount of $16,032.47.  The motion was seconded by Mr. Rothenberger and carried unanimously.

 

Monthly Reports

 

A.  Treasurer’s Report

 

Manager Seitzinger entered the monthly Treasurer’s Report into the record.

 

B.  State Police Report

 

Manager Seitzinger entered the State Police Report into the record. 

 

C.  Building Inspector Report

 

Manager Seitzinger entered the Building Inspector Report into the record.

 

 

D.  Fire Marshal Report

 

Fire Marshal Wetzel entered the Fire Marshal Report into the record. 

 

E.  Road Report

 

Road Foreman Latshaw entered the Road Report into the record.

 

Special Items

 

A.  Public Hearing – Agricultural Security District Area Addition – Sharon S. Moll

      Trust, 1468 Markley Road – 18.48 Acres

 

The Chair of the meeting was turned over to Township Solicitor Joseph Bresnan.  In the presence of a court reporter Mr. Bresnan entered exhibits into the record and presented the public hearing notice.

 

Mr. Fain moved to approve Resolution #2017-44, addition of Sharon S. Moll Trust property to the Upper Hanover Township Agricultural Security District Area.  The motion was seconded by Mr. Rothenberger subject to a correction to the second parcel number listed on the approval resolution.  The motion carried unanimously.

 

The Chair of the meeting was returned to Chairman Fried.

 

B.  Mark Faulkner – Uniform Construction Code

 

Mr. Faulkner inquired on the status on Township enforcement activities relating to a basement bedroom located at 2418 Gramm Road.  Township Engineer Weber explained the status and reviewed the last violation letter sent to the property owner.  It was also noted that the property owner submitted an appeal to the Building Code Board of Appeals.

 

Planning and Zoning

 

A.  Zoning

 

1.  Zoning Hearing, J. Martin Firely for Firely Enterprises, LLC – December 20,

     2017

 

The Board of Supervisors reviewed the zoning hearing application for the December 20, 2017 hearing.  Tom McCaa of 2578 Geryville Pike presented comments in regard to the application.

 

A poll of the Board of Supervisors indicated that a majority of the Township Supervisors were in favor of sending the Township Solicitor to enter an appearance and oppose the application.

 

 

 

B.  Subdivision and Land Developments

 

1.  Sosnin Subdivision Waiver Recommendation

 

Mr. Fain moved to approve a waiver to Section 425-500.D(1)(a) and Section 425-500.D(2) – required street trees.  The motion was seconded by Mr. Rothenberger and carried unanimously.

 

2.  Sosnin Subdivision Preliminary and Final Approval

 

Mrs. Diehl moved to provide preliminary and final approval of the Sosnin Minor Subdivision Plan as per the plan prepared by STA Engineering, Inc. dated July 5, 2017, last revised November 10, 2017 incorporating the recommendations contained in the LTL Consultants review letter dated November 29, 2017.  The motion was seconded by Mr. Fiorito and carried unanimously.

 

3.  Northgate Commercial and Open Space Lot Line Amendment Waiver

     Recommendation

 

Mr. Fain moved to approve a waiver to Section 309.1.D.1.a which requires existing features be shown on a minor subdivision/lot line change  plan.  The motion was seconded by Mr. Rothenberger and carried unanimously.

 

 4.  Northgate Commercial and Open Space Lot Line Amendment - Preliminary

      and Final Approval

 

Mr. Rothenberger moved to approve Resolution #2017-47 to provide preliminary and final approval for the Northgate Open Space A and Commercial Lot Line Change.  The motion was seconded by Mr. Fain and carried unanimously.

 

5.  Northgate Phase 2G Waiver Recommendations

 

Mrs. Diehl moved to approve a waiver from the requirement of SALDO Sections 500.4.A, 1001.8.A, 1002.4 and appendix B which requires that street trees shall be selected from the approved lists contained within the ordinance.  The motion was seconded by Mr. Fain and carried unanimously.

 

6.  Northgate Phase 2G Preliminary and Final Approval

 

Dean Rittenhouse of TH Properties presented information to the Board of Supervisors concerning the Northgate Phase 2G plan.  Discussion ensued.

 

Mr. Fain moved to approve Resolution #2017-46.  The motion was seconded by Mr. Rothenberger and carried unanimously.

 

Committee Reports

 

A.  Budget and Finance Committee – Mr. Fiorito

 

1. Resolution 2017-42, Adoption of 2018 Township Budget

 

Mr. Fiorito provided an overview of the proposed 2018 Upper Hanover Township Budget.  Mr. Fiorito reported that the Township real estate tax rate is at the same rate for the thirteenth straight year. 

 

Mrs. Diehl moved to adopt Resolution #2017-42, adoption of 2018 Township Budget.  The motion was seconded by Mr. Rothenberger and carried unanimously

 

2.  Resolution #2017-43, Inter-Fund Transfer Authorization

 

Mr. Rothenberger moved to approve Resolution #2017-43.  The motion was seconded by Mr. Fiorito and carried unanimously.

 

3.  2018 Salary Schedule

 

Mrs. Diehl moved to approve the 2018 Salary Schedule with a salary rate increase of 2.5%.  The motion was seconded by Mr. Fioroto and carried unanimously.

 

B.  Personnel Committee – Mrs. Diehl and Mr. Fain

 

1. William Brant Six Month Probation Completion

 

A letter from Road Foreman Thomas Latshaw to recommend the approval of the William Brant six month employment probation was presented.  Mrs. Diehl moved to approve the completion of William Brant’s six month probation.  The motion was seconded by Mr. Fain and carried unanimously.

 

C.  Open Space, Parks and Recreation Committee – Mr. Fried

 

Mr. Fried reported that the Parks and Recreation Committee meeting in December was canceled.

 

An update was provided on the Mill Hill Trail Eagle Scout project and the installation of a concrete marker at the highest point in Montgomery County located at Mill Hill.

 

D.  Regional Planning and Planning Committee – Mr. Rothenberger

 

It was reported that the December Regional Planning Meeting is canceled.

 

E.  Sewage and Water Committee – Mr. Fiorito

 

Mr. Fiorito provided an update on the lab building construction project for the Upper Hanover Authority.  It was noted that a May 2018 completion date is projected.  Mr. Fiorito also provided an update on the ongoing water main replacement project.

 

 

 

 

F.  Bridge and Road Committee – Mr. Fiorito and Mr. Fried

 

A report was not presented.

 

G.  Public Safety Committee – Mr. Fiorito and Mr. Fried

 

Mr. Fried reported that he met recently with the Pennsylvania State Police Station Commander.  Chairman Fried reported upon the purchase of bicycle repair parts in the amount of $1,918.00 in order that the state police can patrol local trails.

 

Township Engineer’s Report

 

A.  Escrow Releases

 

Township Engineer John Weber presented the monthly Engineer’s Report. 

 

Mr. Rothenberger moved to approve Escrow Release #12 for the Reserve at Macoby Run Phase 4A in the amount of $18,686.34 as certified by the Township Engineer.  The motion was seconded by Mr. Fiorito and carried unanimously.

 

Mr. Fiorito moved to approve Escrow Release #5 for the Reserve at Macoby Run Phase 4B in the amount of $14,039.91 as certified by the Township Engineer.  The motion was seconded by Mrs. Diehl and carried unanimously.

 

B.  Bridge Inspection Proposal for Bridges 20 Feet and Under

 

Township Engineer Weber presented a proposal dated December 8, 2017 in the amount of $7,500 for conducting the inspection of Township owned bridges 20 feet and under.  Mr. Fain moved to accept the proposal.  The motion was seconded by Mr. Rothenberger and carried unanimously.

 

C.  Other

 

John Weber reported upon a recent meeting with the Montgomery County Conservation District regarding the required stabilization and final restoration at the Upper Perkiomen School district Middle School Project location.

 

John Weber presented an update on the enforcement activities at 53 and 57 Gravel Pike.  The Board of Supervisors authorized the Township Engineer to proceed with filing a citation for the property.

Old Business

 

A. Resolution #2017-48 – Wayfinding Sign Program

 

Mr. Rothenberger moved to adopt Resolution #2017-48.  The motion was seconded by Mrs. Diehl and carried unanimously.
