UPPER HANOVER TOWNSHIP BOARD OF SUPERVISORS REGULAR MEETING MINUTES OF SEPTEMBER 12, 2017

 

 

Call to Order and Roll Call

 

The meeting was called to order at 7:00 p.m. by Chairman Eugene Fried followed by the Pledge of Allegiance to the Flag. Township Supervisors in attendance were Dorothy Diehl, Eugene Fried, Steven Rothenberger and Ben Fiorito by speaker phone.  Staff members in attendance were Joseph Bresnan, Township Solicitor, Thomas Latshaw, Road Foreman, Michael Wetzel, Fire Marshal, John Weber, Township Engineer and Stanley W. Seitzinger, Jr., Township Manager.

 

Citizen Comments

 

Andrew Lechman, Reserve at Macoby Run, expressed support for the proposed Upper Perkiomen School District Middle School Project.

 

Approval of Minutes

 

Mrs. Diehl moved to approve the August 7, 2017 Workshop Meeting Minutes and the August 8, 2017 Regular Meeting Minutes.  The motion was seconded by Mr. Rothenberger and carried affirmatively.

 

Monthly Invoices

 

A.  Previously Paid Bills Authorization and Approval of Monthly Bills to be Paid

 

Mrs. Diehl moved to approve the previously paid bills in the amount of $25.66 from the General Fund and $79.40 from the Parks and Recreation Fund and to approve the monthly bills payment in General Fund in the amount of $98,977.62, Parks and Recreation Fund in the amount of $1,178.25, State Aid Fund in the amount of $65,774.02 and Escrow Fund in the amount of $18,123.04.  The motion was seconded by Mr. Rothenberger and carried affirmatively.

A.  Treasurer’s Report

 

Manager Seitzinger entered the monthly Treasurer’s Report into the record.

 

B.  State Police Report

 

Manager Seitzinger entered the State Police Report into the record. 

 

C.  Building Inspector Report

 

Manager Seitzinger entered the Building Inspector Report into the record.

 

D.  Fire Marshal Report

 

Fire Marshal Wetzel entered the Fire Marshal Report into the record. 

 

E.  Road Report

 

Road Foreman Latshaw entered the Road Report into the record.

 

Special Items

 

A.  Public Hearing – Agricultural Security District Area Addition – Liam D.

      Pyskaty Property, 1368 Hendricks Road – 27.93 Acres

 

The Chair of the meeting was turned over to Township Solicitor Bresnan. In the presence of a court reporter, the following exhibits where entered into the record:

 

 

 

 

 

 

     

Residents in attendance did not present comments.

 

Mr. Rothenberger moved to adopt Resolution #2017-33 to add the Liam D. Pyskaty Property to the Upper Hanover Township Agricultural Security District Area. The motion was seconded by Mrs. Diehl and carried affirmatively.

 

B. Ordinance #2017-02, An Ordinance Amending the Code of the Township of Upper Hanover to Remove All References to the Rates and Regulations for the Palm Collection System and the Now Defunct Waste System Authority of Western Montgomery County

 

Mr. Bresnan reviewed the purpose of the proposed Ordinance.

 

Mrs. Diehl moved to adopt Ordinance #2017-02. The motion was seconded by Mr. Rothenberger and carried affirmatively.

 

C. Public Hearing, Earnest and Denise Christman Conditional Use –

     2429 Treichler Road

 

Township Solicitor Bresnan reported that the size of the proposed garage was reduced and that the Conditional Use application was withdrawn.

 

Planning and Zoning

 

A.  Zoning

 

Zoning business was not presented.

 

B.  Subdivision and Land Developments

 

1.  Geryville Self Storage Land Development Final Plan

 

Karl Leitner. P.E. of Barry Isett & Associates reviewed the status of compliance for the Geryville Self Storage Land Development Plan.

 

Mrs. Diehl moved to adopt Resolution #2017-34 to approve the final land development plan for the Geryville Self Storage Project. The motion was seconded by Mr. Rothenberger and carried affirmatively.

 

2.  Upper Perkiomen School District Middle School Land Development Final Plan

 

Township Solicitor Bresnan explained that the most recent Township Engineer review letter for the Upper Perkiomen School District Middle School Land Development Project indicated that the current draft of the plan was in full compliance with Township Ordinances. Mr. Bresnan reported that the Upper Hanover Township Planning Commission had unanimously recommended approval of the plan at the Planning Commission meeting of September 6, 2017. Mr. Bresnan presented additional comments regarding pending appeals and challenges filed relating to the plan.

 

Joseph Clement, Upper Perkiomen School District Solicitor, introduced representatives of the Upper Perkiomen School District and presented comments regarding the status of the land development plan.

 

Ethan O’Shea, Esquire representing William Chrisman, commented that there were enough unresolved issues that the Board of Supervisors should not grant final approval.

 

Christopher Mullaney, Esquire, presented comments in opposition to the granting of final plan approval.

 

Mr. Clement presented additional comments to the Board of Supervisors.

 

Residents Melanie Cunningham and Labrea Huff presented comments regarding the Upper Perkiomen School District Middle School Land Development Project.

 

Chairman Fried requested a motion for Resolution #2017-35 for granting final land development approval to the Upper Perkiomen School District Middle School Land Development Plan.

 

Mr. Fiorito moved to adopt Resolution #2017-35. The motion was seconded by Mr. Fried. The motion carried affirmatively with Mr. Fiorito, Mrs. Diehl and Mr. Fried voting yes and with Mr. Rothenberger voting no.

 

Members of the Board of Supervisors presented additional comments.

 

The hearing was closed and the Chair of the meeting was returned to Chairman Fried.

 

3. The Sosnin Tract Minor Subdivision Waivers

 

The waivers were tabled for further review.

 

4. Glenwood Chase Minor Subdivision Preliminary and Final Approval

 

The plan was tabled for further review.

 

5. Glenwood Chase Amended Final Plan Approval

 

The plan was tabled for further review.

 

6. P&B Partitions Land Development Waivers

 

Discussion ensued. Mr. Fiorito moved to approve the following waivers:

 

Section 425-405 – Driveway Spacing (SALDO)

 

Section 415-18.B.8 – (Stormwater Ordinance) - Detention Basin Setback, requirement that the toe of slope of a detention basin to be a minimum of 25 feet from a property line.

 

The motion was seconded by Mrs. Diehl. The motion carried affirmatively with Mr. Fiorito, Mrs. Diehl and Mr. Fried voting yes and with Mr. Rothenberger abstaining from the vote.

 

7. Parklands Subdivision Entry into 18 Month Maintenance Program

 

Mr. Fiorito moved to authorize entering the Parklands Subdivision into the 18 month maintenance program. The motion was seconded by Mr. Rothenberger and carried affirmatively.

 

8. Parklands Subdivision, Acceptance of Roads and Acceptance of Open Space

    Parcel #1

 

Mrs. Diehl moved to approve Resolution #2017-38 and Resolution #2017-39 to accept the roads at the Parklands Subdivision and to accept the Open Space Parcel #1. The motion was seconded by Mr. Rothenberger and carried affirmatively.

 

(Mr. Fiorito departed the meeting at 7:55 p.m.)

 

Committee Reports

 

A.  Budget and Finance Committee – Mr. Fiorito

 

Manager Seitzinger reported that work was underway on the 2018 Township Budget.

 

B.  Personnel Committee – Mrs. Diehl and Mr. Fain

C.  Open Space, Parks and Recreation Committee – Mr. Fried

 

A report was not presented.

 

D.  Regional Planning and Planning Committee – Mr. Rothenberger

 

Mr. Rothenberger reported that a Regional Planning Commission Meeting was not held in August.

 

E.  Sewage and Water Committee – Mr. Fiorito

 

A report was not presented.

 

F.  Bridge and Road Committee – Mr. Fiorito and Mr. Fried

 

Mr. Fried reported upon the completion of the maintenance work at the Leshers Mill Road Bridge.

 

G.  Public Safety Committee – Mr. Fiorito and Mr. Fried

 

Mr. Fried reported upon a meeting held with residents regarding the receipt of hate mailings.

 

Township Engineer’s Report

 

A. Escrow Releases

 

Mrs. Diehl moved to approve the following escrow releases:

 

1.      Reserve at Macoby Run, Phase 4A, Release #10 - $20,800.00

 

2.      Reserve at Macoby Run, Phase 4B, Release #4 - $99,203.50

 

The motion was seconded by Mr. Rothenberger and carried affirmatively.

Cathy Davidson of Pennsburg Borough thanked the Board of Supervisors for their thoughtful consideration on the Upper Perkiomen School District Middle School Project.
