UPPER HANOVER TOWNSHIP BOARD OF SUPERVISORS REGULAR MEETING MINUTES OF AUGUST 9, 2011

 

 

 

Call to Order and Roll Call

 

The meeting was called to order at 7:00 p.m. by Chairman Fain followed by the Pledge of Allegiance to the Flag.  Township Supervisors in attendance were Richard Fain, Ben Fiorito, Eugene Fried and Mary Gibbs Kershner.  Staff members in attendance were Jeffrey Ashman, Fire Marshal, Larry Buck, Road Foreman, Edward Skypala, Township Solicitor and Stanley W. Seitzinger, Jr., Township Manager.

 

Citizen Comments

 

Phil Jarinko of 1059 Palm Hill Road questioned why the Pennsylvania Department of Transportation was replacing the existing one lane bridge on Palm Hill Road with a new one lane bridge and suggested that Upper Hanover Township seek an injunction to stop the current bridge construction project. Discussion ensued.

 

Approval of Minutes

 

Mrs. Kershner moved to approve the July 11, 2011 Board of Supervisors Workshop Meeting Minutes, the July 12, 2011 Board of Supervisors Regular Meeting Minutes and the August 2, 2011 Joint Meeting of The Upper Hanover Authority and the Upper Hanover Township Board of Supervisors.  The motion was seconded by Mr. Fried and carried affirmatively. 

 

1.  Previously Paid Bills Authorization

 

Mrs. Kershner moved to approve the previously paid bills in the amount of $829.58 from the General Fund and $70,359.00 from the Open Space Fund.  The motion was seconded by Mr. Fried and carried affirmatively.

 

2.  Approval of Monthly Bills to be Paid

 

Mrs. Kershner moved to approve the monthly bills payment in the General Fund in the amount of $50,836.42, Parks and Recreation Fund in the amount of $3,148.98 and Escrow Fund in the amount of $31,608.68.  The motion was seconded by Mr. Fried and carried affirmatively.

 

Monthly Reports

 

1.  Treasurer’s Report

 

Manager Seitzinger entered the monthly Treasurer’s Report into the record.

 

2.  State Police Report

 

Manager Seitzinger entered the State Police Report into the record. 

 

3.  Building Inspector Report

 

Manager Seitzinger entered the Building Inspector Report into the record.

 

4.  Fire Marshal Report

 

Fire Marshal Ashman entered the monthly Fire Marshal Report into the record.

 

5.  Road Report

 

Manager Seitzinger read and presented the Road Report into the record.

 

Special Items

 

1. Bridge Replacement Projects – Gravel Pike

 

Chairman Fain reported upon a letter received from the Pennsylvania Department of Transportation that agreed with the Township’s position to replace the two existing bridges on Route 29 one lane at a time, thereby keeping the roadway open to traffic during construction.

 

2. Public Hearing Ordinance # 2011-04, An Ordinance Amending the Code of the 

    Township of Upper Hanover, Chapter 438, Taxation, to Revise Provisions

    Pertaining to the Earned Income Tax

 

The Chair of the meeting was turned over to Township Solicitor Skypala. Solicitor Skypala read the public hearing notice and entered the public hearing notice, the letter to the Montgomery County Law Library and the proof of publication into evidence. Mr. Skypala inquired if anyone in attendance wished to present testimony and residents in attendance did not present testimony. Mr. Skypala requested whether the Board of Supervisors wished to take an action on adoption of the presented ordinance.

 

Mr. Fiorito moved to adopt Ordinance # 2011-04. The motion was seconded by Mr. Fried and carried affirmatively.

 

3. Fire and Emergency Services Ordinance and Resolution – Eastern Berks Fire 

    Department

 

The matter was tabled for further review.

 

Planning and Zoning

 

1.  Zoning

 

There were not any new zoning items for discussion.

 

2.  Subdivisions and Land Developments

 

A. Wisser Subdivision Final Plan Approval – Reaffirmation

 

Mrs. Kershner moved to provide a reaffirmation of the Wisser Subdivision Final Plan as per the plan prepared by Berks Surveying & Engineering, Inc. dated May 12, 2010 and last revised November 4, 2010 as previously approved January 11, 2011. The motion was seconded by Mr. Fried and carried affirmatively.

 

Committee Reports

 

1.  Budget and Finance Committee – Mr. Fiorito

 

Mr. Fiorito reported that a schedule was prepared regarding meetings on the 2012 township budget.

 

2.  Personnel Committee – Mrs. Kershner and Mr. Fried

 

A report was not presented.

 

3.  Open Space, Parks and Recreation Committee – Mr. Fried

 

Mr. Fried presented information regarding work on the preparation of the specification for the water filter at the Upper Hanover Township Maintenance Building. Mr. Fried reported that additional trash containers are under preparation for use at the pavilion.

Mr. Fried reported upon scheduled over seeding at the soccer field play area.

 

4.  Renewable Energy and Recycling Task Force – Mrs. Bieler and Mrs. Kershner

 

Mrs. Kershner provided an update on the status of the required recycling ordinance.

 

5.  Regional Planning and Planning Committee – Mrs. Kershner

 

Mrs. Kershner reported that a meeting was not held in the month of July.

 

6.  Sewage and Water Committee – Mr. Fain

 

Chairman Fain reported upon the joint meeting held with the Upper Hanover Authority on August 2, 2011.

 

7.  Bridge and Road Committee – Mr. Fried

 

A. 2011/2012 PennDOT Winter Services Agreement

 

Mr. Fried moved to approve the 2011/2012 PennDOT Winter Services Agreement. The motion was seconded by Mrs. Kershner and carried affirmatively.

 

B. Work Schedule

 

Road Foreman Larry Buck reported that the paving work would commence on August 15, 2011 with the oil and chip surface treatments to be scheduled for the last week of August from August 29, 2011 to September 2, 2011. Mr. Buck reported that the cinder area of the trail at Camelot Park along with the entrance to Camelot Park would be paved following the completion of the roadway projects.

 

8.  Public Safety Committee – Mr. Fried and Mrs. Kershner

 

Mr. Fried commented upon reports received from the Upper Perkiomen Valley Regional Police Department and expressed appreciation for the ongoing assistance provided by the department.

 

Township Engineer’s Report

 

1. Macoby Woods (Kistler Tract - Release from Maintenance)

 

Mrs. Kershner moved to authorize closeout and release of the financial security for the Macoby Woods Subdivision (Kistler Tract) in the amount of $110,881.00 associated with the 18 month maintenance agreement subject to receipt of payment due for professional services. The motion was seconded by Mr. Fried and carried affirmatively.

 

Township Manager’s Report

 

A report was not presented.

 

Township Solicitor’s Report

 

1. Resolution # 2011-14 - Industrial Development Authority - Upper Perkiomen            

     Valley Ambulance

 

Mrs. Kershner moved to adopt Resolution # 2011-14. The motion was seconded by Mr. Fiorito and carried affirmatively.

 

2.  Mini-Bikes and All-Terrain Vehicles

 

Mr. Skypala reported that the Township Zoning Officer is examining an issue relating to the use of mini-bikes and all-terrain vehicles. A brief discussion ensued.

 

Old Business

 

1.  Dump Truck Sale - Municibid

 

Mr. Fiorito moved to authorize sale of the 1991 International Dump Truck (VIN: 1HTGGG3T3MH323400) in the amount of $13,300.00 as per the high bid through Municibid to Stephen Rice. The motion was seconded by Mr. Fried and carried affirmatively.

 

2. Line Painting Bid Award

 

Mr. Fried moved to award the 2011 Line Painting Bid to Interstate Road Management in the amount of $ 30,510.00. The motion was seconded by Mrs. Kershner and carried affirmatively.

 

New Business

 

New Business was not presented.

 

Mr. Fain inquired as to whether citizens in attendance wished to present comments. Additional comments were not presented.

 

Adjournment

 

Mrs. Kershner moved to adjourn the meeting at 7:57 p.m.  The motion was seconded by Mr. Fried and carried affirmatively.
